July 2 Legislative Elections : Constitutional Court Continues to Receive Minutes from Wilaya Committees

The Constitutional Court, within the framework of its jurisdiction, continues this Saturday to receive the minutes of the Wilaya electoral committees regarding the legislative elections that took place last Thursday.

The delivery of the Wilaya electoral committees' minutes is carried out in accordance with the approved legal procedures, taking place at the level of the Constitutional Court's registry in exchange for a receipt of delivery. This complies with the provisions of Articles 271 (Paragraph 2) and 275 (Paragraph 5) of Ordinance No. 21-01, which contains the Organic Law relating to the electoral regime, amended and supplemented.

The law stipulates that the deposition of the minutes of the Wilaya electoral committees or the electoral districts for residents abroad "takes place within a maximum of 96 hours following the closure of the vote, while the President of the National Independent Authority for Elections may, if necessary, extend the deadline by a maximum of 48 hours," as provided for in Article 271.

Immediately after the closure of the vote, the municipal sub-committees initiated the vote-counting process at the level of polling stations and centers, recording their results in official minutes and transferring them to the Wilaya committees.

Based on the counting minutes, the National Independent Authority for Elections announces the provisional results of the election of members of the People's National Assembly. According to Article 209 (Paragraph 3) of the law, "every list of candidates for the legislative elections, every candidate, and every party participating in these elections has the right to appeal them by filing a request in the form of a petition submitted to the Constitutional Court within 48 hours following the announcement."

In this framework, "the Constitutional Court notifies the list or the candidate whose victory is being contested to submit a written memorandum to the Constitutional Court within 72 hours from the date the appeal is filed," in accordance with Article 209 (Paragraphs 3 and 4).

Appeals are decided upon by the same Court "within three days after the expiration of this deadline," as provided for in Article 210 of the law. The final results are to be announced "within a maximum period of 10 days from the date of receiving the provisional results, and this deadline may, if necessary, be extended by a decision of the President of the Constitutional Court," according to Article 211 of the electoral law.
